These Terms & Conditions ("Terms") govern your access to and use of KrivaCBDA.com (the "Site") and any products purchased through it, operated by Kriva, Inc., ("Kriva," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use this Site or purchase Kriva products. By using the Site, you represent that you meet this requirement and that you are legally permitted to purchase hemp-derived products in your state or country of residence.

●      Some states and countries restrict or prohibit the sale, possession, or use of hemp-derived cannabinoid products. You are responsible for confirming that purchasing and using Kriva products is legal where you live and where the product will be used.

●      Kriva reserves the right to refuse or cancel any order, including orders shipping to jurisdictions where our products are restricted.

Your use of the Site and submission of information through the Site are also subject to our Privacy Policy, which explains how Kriva collects, uses, discloses, and protects personal information. Please review the Privacy Policy (available at https://krivacbda.com/policies/privacy-policy) before using the Site or placing an order.

2. Product Information & Health Disclaimers

Kriva products are topical wellness products intended for use by licensed massage therapists, chiropractors, and other recovery professionals, and their clients or patients, as part of a broader recovery routine.

●      Statements about our products have not been evaluated by the U.S. Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease.

●      Cannabinoid content, including any THC-related testing results, may vary by product and batch and is reflected in the applicable product label or Certificate of Analysis, where available. References to “non-detectable” THC mean below the applicable laboratory’s stated limit of detection for the tested sample (typically less than 0.003%). Kriva does not guarantee that use of any hemp-derived product will not result in a positive drug test.

●      Information on the Site, including educational and research-based content, is provided for general informational purposes only and is not medical advice. Consult a qualified healthcare provider before using any new product, particularly if you are pregnant, nursing, taking medication, or have a medical condition.

●      Individual results vary. Descriptions of potential benefits reflect available research and professional feedback and are not guarantees of outcome.

●      Patch testing is recommended before first use. Discontinue use and consult a healthcare provider if you experience irritation or an allergic reaction.

3. Orders, Pricing & Payment

●      All orders are subject to acceptance and availability. We reserve the right to limit quantities, refuse service, or cancel orders at our discretion, including in cases of suspected fraud or pricing errors.

●      Prices are listed in U.S. dollars and are subject to change without notice. Applicable taxes and shipping fees will be calculated at checkout.

●      Payment is processed through Shopify Payments and/or other third-party payment processors. By submitting payment information, you represent that you are authorized to use the payment method provided.

4. Shipping & Delivery

●     Standard shipping is handled by USPS.  Orders ship in 2 business days, arrive in 3-5. Timeframes are estimates only and are not guaranteed. Kriva is not responsible for delays caused by carriers or circumstances outside our control.

●      Risk of loss and title for products pass to you upon our delivery to the carrier.

●      We currently ship to U.S. destinations only. We do not ship to jurisdictions where the sale or possession of hemp-derived products is restricted or prohibited. It is your responsibility to confirm legality in your destination before placing an order. Shipping availability shown at checkout does not constitute a legal determination that Kriva products may lawfully be purchased, received, possessed, or used in your jurisdiction.

5. Returns & Refunds

We want you to be satisfied with your Kriva purchase. If you are not completely satisfied, you may return eligible items within 30 days of the delivery date for a refund or exchange, subject to the conditions below.

●      Eligibility: To be eligible for a return, items must be unused, unopened, and in their original packaging with seal intact.

●      Timeframe: Return requests must be initiated within 30 days of the delivery date. Requests made after 30 days will not be accepted.

●      How to start a return: Contact us atSupport@KrivaCBDa.com with your order number to request a return authorization. Items returned without prior authorization may not be accepted.

●      Return shipping: We recommend using a trackable shipping method, as Kriva is not responsible for items lost in transit.

●      Refunds: Once we receive and inspect your return, we will notify you of the approval status. Approved refunds will be issued to your original payment method within 10 business days. Original shipping charges are non-refundable.

●      Damaged or incorrect orders: if your order arrives damaged, defective, or incorrect, contact us at Hello@KrivaCbda.com within 7 days of delivery with your order number and photographs of the product, packaging, and shipping materials. If we determine that the product was damaged, defective, or incorrectly fulfilled, we will arrange a replacement, refund, or other appropriate resolution at no additional cost to you.

●      Final sale items: Opened, used, altered, unsealed, or partially used products are final sale and are not eligible for return unless they were damaged, defective, or incorrectly fulfilled. Sample kits, promotional items, clearance items, and professional or bulk orders are final sale unless otherwise stated at checkout or required by applicable law.

●      Exchanges: We do not process direct exchanges unless otherwise approved by Kriva. Eligible exchanges are handled as a return of the original item and placement of a new order.

6. Professional & Sample Program Use

●      Sample requests and professional pricing, where offered, are intended for licensed massage therapists, chiropractors, and other qualifying recovery professionals. Kriva may request verification of professional status and may limit sample quantities.

●      Professional-facing educational materials (including white papers and clinical summaries) are provided for the professional's own reference and are not intended for direct distribution to patients or clients as medical guidance.

●      You may not use Kriva educational materials or professional-facing content to make medical, therapeutic, disease, drug-testing, or regulatory claims regarding Kriva products. Participation in any Kriva professional, sample, wholesale, or education program does not create an agency, employment, endorsement, referral, healthcare, or professional relationship between you and Kriva.

7. Intellectual Property

All content on the Site, including text, graphics, logos, product formulations, and images (including the KRIVA name and logo), is the property of Kriva or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent.

8. User Conduct

When using the Site, you agree not to:

●      Use the Site for any unlawful purpose or in violation of these Terms;

●      Attempt to gain unauthorized access to any part of the Site or its systems;

●      Submit false information, including misrepresenting your professional status to obtain samples or professional pricing;

●      Resell Kriva products without our express written authorization.

●      Make any unauthorized medical, therapeutic, disease, drug-testing, regulatory, or legal-compliance claim regarding Kriva products.

9. Third-Party Links & Services

The Site may link to third-party websites or use third-party services (such as payment processors or email platforms) that are not operated by Kriva. We are not responsible for the content, policies, or practices of any third-party site or service. Please review our Privacy Policy for more information about how we and our service providers collect, use, disclose, and otherwise process information in connection with the Site.

10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, EXCEPT AS OTHERWISE REQUIRED BY LAW.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, KRIVA AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify and hold Kriva harmless from any claims, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from your use or misuse of the Site or products, your violation of these Terms, your violation of applicable law, your misrepresentation of professional status, your unauthorized resale or distribution of Kriva products, or any unauthorized medical, therapeutic, disease, drug-testing, regulatory, or legal-compliance claim made by you regarding Kriva products.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Kriva product shall be brought exclusively in the state or federal courts located in Washington, and each party consents to the personal jurisdiction and venue of those courts. Notwithstanding the foregoing, Kriva may seek injunctive or equitable relief in any court of competent jurisdiction to prevent unauthorized use of its intellectual property, Site, products, or professional materials.

14. Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted to the Site. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
